At approximately 7:05 PM, Judy Watson, Chairman, called the
Planning Board Meeting to order.

Business:
Approval of October 17, 2005 Minutes:
Barry Pritchard stated his name was omitted as attending the
meeting, and he did attend. Lee Phillips made a motion that
we approve the Minutes of October 17, 2005 as corrected. Kenn
Kern seconded the motion. All ayes. Motion carried.
New Business:

No one from the public was present.
Open Board Discussion:
Revision of Zoning Regulations - Building Permits:
Judy opened the Revision of the Zoning Regulations on Building
Permits.
On Page 1 at the top, "Permit Required", after much
discussion, Kenn Kern stated in the first sentence, the word
"structure" should read "building", and
instead of "altered" it should read "extended".
Fran Dellamano said we should revise the regulations so they
are not complicated. Leave the first sentence in, and delete
the second sentence. Anywhere else in the Building Permit sections,
where it refers to "structure" should be referred
as "building" Judy stated as she did at the last meeting,
there will be a glossary of definitions.
Judy referred to the Section, "Supplemental Regulations"
as she did at the last meeting. Page 2, "Accessory Uses
and Structures", under "Permitted Accessory Uses",
that No. 9 was changed from "horses" to "livestock",
and No. 13 from "Garden Shed" to "Shed".
She also referred to Page 3, "The size of a roofed or enclosed
accessory structure shall not exceed 180 square feet in area".
Back to Page 1, "Building Permits", after discussion,
it was decided to delete paragraphs "Application"
and "Action on Application", as the Town provides
various application forms which meets the needs of the project.
Fran agreed it is up to the Town to provide the forms. On Page
1, "Completion of work; Duration of Permit" - that
paragraph should be left in. There was discussion on some people
taking longer than one year to complete the construction of
a home or other building.
As to "Use Permits" - "Permit Required",
top of Page 2, instead of "No premises shall hereafter
be used", it should read "No building shall hereafter
be used"
As to the second paragraph - "Application: issuance or
denial", should be deleted, as again the Town or Code Enforcement
Officer would have the forms.
As to "Certificates of Occupancy" - "Certificate
Required" - that sentence should remain. "Inspection
required prior to issuance" should be deleted.
On Page 2, "Demolition Permits" - "Purpose"
- that paragraph should be left in. On Page 3, "Permit
Required" and "Application Procedure" should
be deleted. The "Appeals" sections A & B should
remain.
As to the section "Fire Prevention and Building Construction"
with the title at the bottom of Page 3, and "Purpose"
and "Administration and enforcement" on the top of
Page 4, those two paragraphs will be left in.
As to "Inspections", Steve Greene stated we do not
have a Fire Marshall, so that whole section on inspections should
be deleted. On the same page, "Records" should be
deleted.
The next section, starting at the bottom of Page 4, "Nonconforming
Structures and Uses" - "Continuance" shall be
left in. Fran quoted "Structural changes may, however,
be made in a nonconforming structure or within a structure devoted
to a nonconforming use, provided that the cost shall not exceed
50% of its value". On Page 5, "Changes in existing
nonconforming Uses" will be stricken, but "Damage
to or destruction of nonconforming Structures" should be
left in this section.
The next paragraph on Page 5, "Building permit required:
hearing" - Fran said we should look at the Building Code.
He tried to find it, but evidently it is packed in a box to
move to the new building. Judy said we should leave that paragraph
in with a question mark.
After discussion, "Termination of nonconforming use"
and "Exemptions" should be scratched, but B (1) and
(2) should be left in.
The section "Incentive Zoning" starting on Page 6
and ending on Page 10 - this section refers to the Town of Oswego's
Comprehensive Plan, which may be 30 years down the road. Fran
stated this section, or at least part of it has no place for
zoning. That would be subdivision regulations. Steve Greene
said we should scratch the whole section.
The last section, "Land Acquisition", from Pages 10
through 13 - Fran suggested the whole section should be stricken.
Now that section is completed, Judy asked for suggestions on
what section to go over at next months meeting. Jeff Boyer suggested
"Signs, Awnings and Canopies", as it is shorter. All
members complied with Jeff's suggestion.
Adjournment:
At approximately 9:05 PM, Lee Phillips made a motion to adjourn
the meeting. Barry Pritchard seconded the motion. All ayes.
Motion carried.
