Old Business:
Approval of May 15, 2006 Minutes:
Lee Phillips made a motion that the minutes of May 15, 2006
be approved. Jeff Boyer seconded the motion. All ayes. Motion
carried.
New Business:
Application #2006-04 - Jeff Draper/Greg Sharkey - Special Permit/New
Business:
Judy Watson opened the Public Hearing on Jeff Draper/Greg Sharkey's
application for a Special Use Permit on property located at
1969 County Rte. 7. Greg Sharkey was requested to sign the application,
as he is the owner of the property in question. There was some
discussion before Jeff Draper got to the meeting, regarding
the survey/site plan relative to various items missing which
the County Planning Board requested. Judy noted that Marge received
the survey today, and hand delivered it to Marty Weiss of the
County Planning Board. Marge didn't expect him to act on it,
as the documents are supposed to be submitted to the County
Planning Board a week before the hearing. However, Marty did
e-mail Marge, and stated the survey did address some concerns,
but it was still not a Site Plan.
Both Jeff Draper and Greg Sharkey appeared at the hearing at
7:06 PM. Judy asked them to step forward, and have a seat at
the table. She stated the Board had quite a few questions, such
as how many cars can be parked. Jeff said 6 cars could be parked
comfortably. She asked how many vehicles could be inside the
garage at one time, and he said 4 vehicles. Judy then asked
just what he is going to do in the detail shop. Jeff said he
would detail cars, trucks, boats and campers now and then. He
said he cleans them, and buffs and polishes them. He said he
does a lot of detail work on race cars. Lee Phillips asked if
he had compressors. Jeff said he does have a compressor and
a tool box. Fran asked if he had city water there, and Jeff
answered no, that if he needs water, he gets it at Mr. Sharkey's
house. He said he lives on Rathburn Road, which isn't that far,
and if need be, he could get buckets of water at home. He said
his hours are 8:30 AM to 5:00 PM, regular business hours. Judy
asked if he had a septic system, and Jeff stated no. Lee asked
about the disposal of waste water, and Jeff said he keeps it
in a bucket. Fran asked how far away the garage is from where
he gets the water from Mr. Sharkey, and Jeff said about 100
feet.
Jeff Boyer asked about parking of the cars. Jeff said he tries
to keep it down to a minimum. He said Greg has a beautiful lawn,
and he doesn't want to park cars all over it. He wants to keep
it neat, and not like a junk yard. Fran asked about the driveway,
as he said it doesn't look very wide. Both Jeff and Greg said
there is room enough for two cars wide, and when Jim Lockwood
owned it, he had large trucks going in and out of there. Jeff
proceeded to point to the map so Fran could see where the garage
was in relation to Mr. Sharkey's house, and where the cars park.
Kenn Kern said we need a site plan with all the information
on it. He noted that on the #239, it mentions public water,
but there is no water at the garage. Greg Sharkey said there
is water at the house which is on the property.
Jim Finn suggested that Jeff enlarge the survey map, and place
all the criteria needed for a site plan. Kenn said as to ingress
and egress, it is dangerous going out onto County Rte 7, as
there is hill right there. Fran stated he is going to go out
there, and look over the situation, as he has so many questions.
Jeff was asked about signs, and he said he didn't really want
to put signs up for the business. He said he does most of his
business by word of mouth, and again, he didn't want to take
away from Greg's beautiful lawn.
Kenn said we should table the meeting until next month, July
17th, and mark everything that is needed on the map, with measurements,
setbacks, parking, ingress and egress, and location relative
to surrounding properties. Fran said to be sure to put on the
map, all the footage of where the various items will be. Jeff
said he would comply. Marge asked him to please get the map
to her in plenty of time - not the day of the meeting.

Open Board Discussion:
Judy passed out copies of the Town of Oswego Comprehensive Plan
proposed Land Use Map in color. She explained that she, Greg
Auleta of the Zoning Board, Theresa Cooper, Town Clerk of Oswego
Town, and Donna Scanlon of the County Planning Board have had
some meetings to go over the Comprehensive Plan, and Zoning
Regulations. Barry Pritchard stated that the Comprehensive Map
is for the future, and we would do an overlay for the zoning
districts.
As stated at last month's meeting, Steve said he would compile
a draft for a performance bond regarding towers, telecommunications
and windmills. He drafted it and passed it to the members to
view. There was some discussion on windmills. Fran asked why
he couldn't have a windmill in his back yard that doesn't turn.
Steve explained the Planning may condition it approval of any
application by imposing conditions for dismantling and removed
any energy tower/windmill. This shall be required on the occurrence
of one of any of the following three events: - (1) Non-production
of power for a period of thirty (30) consecutive days; and/or;
(2) Non-rotation of any blade set(s) for a period of thirty
(30) consecutive days, and/or; (3) Objective non-repair, which
evidences a structure of nuisance character for a period of
thirty (30 consecutive days.
Jeff Boyer said at one of the meetings it was suggested removal
after 5 years. Fran asked why we have to do this now. We don't
even have a windmill in the town. After some discussion, Steve
referred to the Ex Post Facto Law. Steve said we could leave
1, 2 and 3 out, and post a bond for $500.
Jim Finn made a motion to accept the Performance Bond with the
amended time frame being 120 days, giving time to repair the
energy tower/windmill. Kenn Kern seconded the motion. 4 Ayes,
1 Nay. Motion carried.
Judy asked if anyone was interested in attending the Planning
and Zoning Summer Schools, either in Hyde Park on July 13th,
or SUNY Geneseo on July 27th. Fran Dellamano suggested we look
into obtain a video. Judy said she would look into it.
Adjournment:
At approximately 8:15 PM, lee Phillips made a motion to adjourn
the meeting. Kenn Kern seconded the motion. All ayes. Motion
carried.
