The
regular meeting of the Town of Oswego Board was held at the
Southwest Community Center on October 4, 1999 at 7:00 PM. The
meeting was called to order by Supervisor Tyrie who opened with
the Pledge of Allegiance. Roll call was taken with the following

Resolution
99-140 Motion by Councilor Schadt and seconded by Councilor
Tierney to approve the minutes of September 6, 1999 and bills
on abstract #10 for the following amounts. All ayes motion carried.

Town
Clerk's Report: Correction to Abstract 8, General Fund
to $6447.50. The County Rabies clinic will be held Wednesday
October 6th from 6-8pm. Clerk's office will be open for anyone
needing to renew or license his or her dog. The Historical Society
will have Dr. Helen Brietbeck as guest speaker on October 7th,
7PM at the Southwest Community Center, everyone welcome. Her
topic will be the Underground Railroad. Mrs. Cooper reported
that she was unable to attend the Town Clerk workshop in Lake
George but received information from the Scriba Town Clerk regarding
budget procedures and other information on audits.
Supervisor's Report: Supervisor Tyrie read his budget
message and announced the tentative budget workshop will be
held on Monday, October 18 th at 7:00 PM at the Southwest Community
Center. A meeting will be helci with 4 different engineers to
discuss the repair of the Community Center, the building committee
will also be notified. The town web site will feature a page
for recognizing area town kids who do something special in school
or the community. The schools will be contacted. The planning
board is asking for a re-evaluation of the Hojack Trail for
snowmobiling in the area. The Tank Farm on Rathburn Road may
be re-opened to train traffic and has the concern of area resident
Andre Doviak who lives on Ash Street. These tracks have been
abandoned for years and many children walk and ride 4 wheel
vehicles on them. Nimo needs to advertise and notify area resident's
of the re-opening of these tracks.
Resolution 99-141 Motion by Councilor Schadt and seconded
by Councilor Phillips to open the public hearing at 7:10 PM
for the purpose of hearing comments regarding Proposed Local
Law No. 1 of 1999. All ayes motion carried. The town clerk read
the following:
Be it enacted that the Oswego Town Board rescinds the December
5, 1983 action of the board identified as Note 9, and Be it
further enacted that Article 5, Section C (2) (a) and (b) shall
have restored thereto the phrase "after receipt and consideration
of a written consultative report from the Town Planning Board".
No public comment regarding the above.
Resolution 99-142 Motion by Councilor Mullen and seconded
by Councilor Tierney to close the public hearing and resume
the regular board meeting at 7:11 PM. All ayes motion carried.
Resolution 99-143 Motion by Councilor Tierney and seconded
by Councilor Mullen to move into executive session to discuss
pending litigation and personnel at 7:12 PM. All ayes motion
carried.
Resolution 99-144 Motion by Councilor Schadt and seconded
by Councilor Mullen to resume regular board meeting at 7:40
PM. All ayes motion carried.
Public Comment: Jim Thompson asked about the recreation
report. Supervisor Tyrie stated that the director was still
working on it. Mr. Thompson also suggested that the after the
meeting if all the candidates who were present at the meeting
would stay and answer some questions and introduce themselves.
The board felt this would be inappropriate. Mr. Shineman from
the Ontario Heights Neighborhood Association announced a meet
the candidate forum to be held at the Hall-Newman Center October
23rd at 10:00 am. Jim Thompson asked about the building committee
and thought that this committee has been inactive since June.
He would be unable to attend the meeting with the engineers
to discuss the community center. Lisa Stevens commented on the
web page for local kids. John Zwierecki stated that Elmina Spencer
who is buried in the Rural Cemetery was a greater hero than
Dr. Mary Walker in his opinion. In an article in the Oswego
Messenger there was an article highlighting her life, he suggested
people read this.
New Business:
Resolution 99-145 Be it resolved the Oswego Town Board
approves the appointment of Carol Barney as a clerk at the rate
of $7.15 per hour. Be it further resolved that the position
would provide no more than 20 hours per week employment. Moved
by Supervisor Tyrie and seconded by Councilor Phillips. All
ayes motion carried.
Resolution 99-146 Whereas, the Oswego Town Board wishes
to adopt the Deferred Compensation Plan for employees, and Whereas
the Oswego Town Board is a local public employer eligible to
adopt the Deferred Compensation Plan for employees of the State
of New York, (the "plan"), Be it resolved the Oswego
Town Board hereby adopts the plan for the voluntary participation
of all eligible employees; Be it further resolved that the Town
Supervisor is authorized to take such actions and enter such
agreements as are required or necessary for the adoption, implementation,
and maintenance of the plan, provided such actions does not
incur additional expense beyond ordinary clerical cost; Be it
further resolved that the Administrative Services Agency is
hereby authorized to file copies of these resolutions and other
required documents with the President of the State of New York
Civil Service Commission. Moved by Supervisor Tyrie and seconded
by Councilor Tierney. All ayes motion carried.
Resolution 99-147 Be it resolved the Oswego Town Board
authorizes the Town Supervisor to prepare an appropriate commendation
honoring Eagle Scout Patrick O. Coffey. Moved by Supervisor
Tyrie and seconded by Councilor Schadt. All ayes motion carried.
Resolution 99-148 Be it resolved the Oswego Town Board
approves modification of the 1999 General Budget as follows:
From A1620.13 to A1010.4 - $ 197.14
From A1990.4 to A2670.4 - $ 53.31
From A1990.4 to A3120.4 - $ 460.82
From A1990.4 to A4540.4 - $ 1725.25
Moved by Supervisor Tyrie and seconded by Councilor Schadt.
ayes motion carried.
Resolution 99-149 Be it resolved the Oswego Town Board
approves the appointment of James Nelson as Dog Control Officer.
Be it further resolved that such appointment shall be for the
remainder of the 1999 fiscal year and shall be compensated on
a pro-rated basis. Moved by Councilor Mullen and seconded by
Supervisor Tyrie. All ayes motion carried.
Resolution 99-150 Be it resolved the Oswego Town Board
schedules a public hearing on the Town 2000 budget to be held
November 4, 1999 at 7PM at the Southwest Community Center. Moved
by Councilor Tierney and seconded by Councilor Phillips. All
ayes motion carried.
Public Comment: Greg Hermman announced that the Oswego
Town Fire Department would be hosting an open house Thursday
October 14th from 6-9 PM at the fire barn. Robert Sharkey had
questions regarding the Nunzi property. Jim Thompson commented
that the road to the Nunzi property would be very costly to
the town to put in. Councilor Schadt commented that there are
many grants and funds available for this property and the town
should take a shot at purchasing this property.
The Town Clerk distributed to each town board member the tentative
2000 budget.
Motion by Councilor Phillips and seconded by Councilor Mullen
to adjourn the regular meeting at 8:10 PM. All ayes motion carried.
