The
regular meeting of the Town of Oswego Board was held at the
Southwest Community Center on September 13, 1999 at 7:00 PM.
The meeting was called to order by Supervisor Tyrie who opened
with the Pledge of Allegiance. Roll call was taken with the
following members present:

Resolution
99-128 Motion by Councilor Mullen and seconded by Councilor
Tierney to approve the minutes of August 2 and 16, 1999 and
bills on abstract #9 for the following amounts. All ayes motion
carried.

Oswego Town
Historian, Charles Groat presented to the town a framed drawing
of the migration of the Rice Family the first settlers in Oswego
Town. This was from the town historical society to the town,
the drawing and framing were done by town resident, Thelma Johnson.
The town clerk reported that hunting sales were up from last
year.
Supervisor's Report: Supervisor Tyrie reported that
the Rathburn Road Trestle party with the neighbors was a great
success. The presentation at the college for the new sign for
Dr. Mary Walker was well attended by local officials and residents.
Also at the presentation it was noted that civil war nurse Almina
Spencer is buried in Rural Cemetery and we have found her grave
and hope to put appropriate maker on her grave.
Resolution 99-129 Motion by Councilor Phillips and
seconded by Councilor Schadt to move into executive session
at 7:08 PM to discuss pending litigation. All ayes motion carried.
Resolution 99-130 Motion by Councilor Tierney and seconded
by Councilor Mullen to resume the regular meeting at 7:35 PM.
All ayes motion carried.
Public Comment: Jim Thompson had questions regarding
the town planning board sub division book. Does the town have
any roads that meet the town’s code? Lisa Stevens asked
about the burning laws in the town and would like some type
of burning restriction passed. Supervisor Tyrie will give the
board other town burning laws he has on file.
New Business:
Resolution 99-131 The Oswego Town board hereby schedules
a public hearing for discussion of Proposed Local Law #1. Be
it further resolved that said hearing shall be held on October
4, 1999 at the Southwest Community Center, commencing at 7:10
PM. Moved by Supervisor Tyrie and seconded by Councilor Mullen.
All ayes motion carried. Proposed Local Law 99-1: be it enacted
that the Oswego Town Board rescinds the December 5, 1983 action
of the board identified as Note 9, and be it further enacted
that Article 5, Section C (2) (a) and (b) shall have restored
thereto the phrase “after receipt and consideration of
a written consultative report from the Town Planning Board”.
Resolution 99-132 Be it resolved that the Oswego Town
Board authorizes Town Clerk Theresa Cooper to attend the Town
Clerk’s Conference in Lake George on September 27th. Be
it further resolved that associated costs of approximately $125.00
shall be considered appropriate town charges. Moved by Councilor
Mullen and seconded by Councilor Tierney. All ayes motion carried.
Resolution 99-133 Be it resolved that the Oswego Town
Board authorizes Town Justices Wells and Jung, and Court Clerks
Wells and Stuart to attend the NYS Magistrates/Clerks School
and Convention in Ellenville from October 10th until October
13th. Be it further resolved that associated costs of approximately
$125.00 per day, per person, shall be considered appropriate
town charges. Moved by Councilor Phillips and seconded by Councilor
Schadt. All ayes motion carried.
Resolution 99-134 Be it resolved the Oswego Town Board
authorizes the transfer of $4,078.00 from A7020.4 to A7020.1.
Moved by Supervisor Tyrie and seconded by Councilor Tierney.
All ayes motion carried.
Resolution 99-135 Be it resolved the Oswego Town Board
authorizes the transfer of $753.89 from A1461.1 to A1461.4.
Moved by Supervisor Tyrie and seconded by Councilor Tierney.
All ayes motion carried.
Resolution 99-136 Be it resolved that the Oswego Town
Board amends Resolution 99-122 (Rathburn Trestle Mural) to add
the names of Ashley Miceli and Rogers Market. Moved by Councilor
Mullen and seconded by Councilor Schadt. All ayes motion carried.
Resolution 99-137 Be it resolved the Oswego Town Board
supports Caroline Dunn’s submission of a Decentralization
Grant Application requesting funding of the program “From
Nature into Art”. Be it further resolved that the Oswego
Town Board consents to serve as the sponsoring not-for-profit
agency. Moved by Supervisor Tyrie and seconded by Councilor
Schadt. All ayes motion carried.
Resolution 99-138 Be it resolved that the Oswego Town
Board confirms the action of the Town Planning Board amending
the subdivision regulation of the Town of Oswego as follows:
Replace Section I, Part K Paragraph 2 and Paragraph 3 with the
following:
2. Road-Public Vehicular Access, which is public by virtue of
having been and continuing to be approved, accepted and maintained
by the NY State Department of Transportation or County or Town
or Village Highway Superintendents.
a. Major Road-A road intended to serve heavy flows of traffic
from minor roads or as a business road providing access to business
properties.
b. Minor Road-A road intended to serve primarily as an access
to abutting residential properties.
Be it further enacted that the remainder of Section I Park K
Paragraph 2 shall be renumbered as 3, 4, 5, 6, 7, 8, and 9.
Moved by Supervisor Tyrie and seconded by Councilor Phillips.
All ayes motion carried.
Resolution 99-139 For the safety of Town Employees
and Police Officers transporting prisoners for immediate arraignment
to the Oswego Town Hall, be it resolved that two reserved parking
spaces be designated and signed on the north side of the Town
Justice entry door at the Oswego Town Hall. Moved by Councilor
Tierney and seconded by Councilor Mullen. All ayes motion carried.
Public Comment: Jim Thompson had a question regarding
the building permit application. John Zwierecki asked about
getting a simplified budget form like they had years ago. Supervisor
Tyrie explained he gave him one last year. Barry Pritchard asked
about hydrant fees and hydrants on North Star Blvd. John Zwierecki
asked about the Nunzi property and if it was a St. Lawrence
Commission Project. Olin Pritchard asked about the repair of
the Community Center. Jim Thompson asked if the summer recreation
program was over and if a report would be coming with cost etc.
Supervisor stated the Nunzi property would need town wide approval,
the recreation program came in under budget and a survey would
be sent to the parents of children who regularly attended. At
the October meeting he will present engineers report about the
community center.
Motion by Councilor Tierney and seconded by Councilor Phillips
to adjourn the meeting at 8:05 PM. All ayes motion carried.
