The
regular meeting of the Town of Oswego Board was held at the
Southwest Community Center on August 14, 2000 at 7:00 PM. The
meeting was called to order by Supervisor Tyrie who opened with
the Pledge of Allegiance. Roll call was taken with the following
members present:

The Supervisor
stated the budget preparation process has begun and the Town
Board was taken an active part in this process.
Resolution 145-2000 Be it resolved the Oswego
Town Board approves the following budget modification to the
2000 general budget: transfer $6.67 from A1990.4 (Contingent
Acct.) to A1220.4 (Supervisor Contractual). Motion by Supervisor
Tyrie and seconded by Councilor Mahaney. All ayes motion carried.
Town Clerk's Report: The clerk reported $1,302.50
was received and disbursed for the month of July. Sporting license
sales began today. On September 14, 2000 at the Southwest Community
Center the Historical Society will host a presentation on the
local schools of Oswego Town. The Historical Society has also
submitted a design for a stamp cancellation in honor of Dr.
Mary Walker who will be inducted into the National Women's Hall
of Fame. This special cancellation will held October 5, 2000
at 6:30 PM at the community center. A postcard is also being
designed and will be for sale at that time. Aaron and Diana
Gordon have submitted the artwork for these projects.
Resolution 146-2000 Be it resolved the Oswego
Town Board approves the minutes of the July 10, 2000 meeting
of the Oswego Town Board. Moved by Councilor Mahaney and seconded
by Supervisor Tyrie. All ayes motion carried.
Resolution 147-2000 Be it resolved the Oswego
Town Board approves the Town Clerk's audit and the payment of
the following vouchers for abstract #8.

Councilor Tierney and seconded by Councilor Pratt. All ayes
motion carried.
Resolution 148-2000 Motion by Councilor Pratt
and seconded by Councilor Tierney to open the public hearing
for Local Law 1-2000 at 7:05 PM. All ayes motion carried. The
town clerk read the following legal notice which was published
in the Palladium Times.
Proposed Local Law 1-2000: Whereas the Oswego
Town Board seeks to ensure the Town Land Use Ordinance and Sub
Division Regulations are enforced fairly and efficiently, and
Whereas regular meetings of the Zoning Board of Appeals and
the Planning Board are necessary if such enforcement is to occur,
and Whereas members of both such Boards have expressed concerns
relating to the ability of the boards to meet Quorum requirements,
therefore Be It Enacted that the Town Land Use Ordinance shall
be amended as follows: add to Article V Section F. Supplementor;
the following Paragraph 3. Planning Board Membership b. Members
shall be expected to be regular in their attendance at Planning
Board Meetings. Absence from four (4) regularly scheduled meetings
during a twelve (12) month period may result in removal from
membership. Removal shall occur only following a public hearing
before, and a vote of, the Town Board. Such hearing shall be
held not sooner than ten (10) days, but not more than thirty
(30) days after a formal charge for attendance has been filed
with the Town Clerk. Such charge may be filed by any town resident.
Public Comment: Town Resident Tom Irwin spoke
in favor of this local law, no opposed.
Resolution 149-2000 Motion by Councilor Tierney
and seconded by Councilor Pratt to close the public hearing
for Local Law 1-2000 at 7:09 PM. All ayes motion carried.
Resolution 150-2000 Motion by Supervisor Tyrie
and seconded by Councilor Pratt to accept Local Law 1-2000.
All ayes motion carried. Attorney Greene made amendment to the
local law to delete the word "public". Councilor Mahaney
suggested that the Zoning Board of Appeals be included in Paragraph
3 after Planning Board Membership. Friendly amendment to delete
"public" and add Zoning Board of Appeals to section
"B".
Supervisor's Report: The supervisor has been
notified of speed limit reductions for part of Rathburn Road
and West Lake Road. He also stated that he has been requested
by the board not to respond during the public comment part of
the meeting.
Resolution 151-2000 Be it resolved that the
Oswego Town Board approves the minutes of the July 3, July 17,
and August 7, 2000 meetings of the Oswego Town Board. Motion
by Councilor Mullen and seconded by Councilor Tierney. All ayes
motion carried.
Public Comment: Residents were concerned why
the board would not be answering questions during public comment,
and who made this rule. Questions were raised as to the status
of the Community Center, are bids out for the project and did
the board have a vote as to why they will not comment to the
public. Has the town looked into a payroll service? A town resident
read a statement about his dog and feels the local dog ordinance
should be revised.
Unfinished business:
Resolution 152-2000 Be it resolved that the Oswego
Town Board removes from the table Resolution 105-2000. Moved
by Councilor Pratt and seconded by Councilor Tierney. All ayes
motion carried. Discussion followed regarding the increase in
building permits.

Be it further resolved that building permits shall expire one
year after the date of issue. Be it further resolved that building
permits may be renewed one time only, for a fee equal to 50%
of the original fee, provided renewal occurs within 60 days
of expiration. Motion by Supervisor Tyrie and seconded by Councilor
Mahaney. All ayes motion carried.
Resolution 153-2000 Be it resolved that the
Oswego Town Board authorizes Marsha Echelbarger to attend the
Planning Board Course offered by SUNY/ESF. Be it further resolved
that all associated cost shall be considered legitimate town
charges. Moved by Councilor Mahaney and seconded by Councilor
Pratt. All ayes motion carried.
Resolution 154-2000 Be it resolved that the
Oswego Town Board approves the use of the Building Permit Application
(attachment A) and the Application to the Oswego Town Planning
Board (attachment B). Moved by Supervisor Tyrie and seconded
by Councilor Tierney. All ayes motion carried.
Resolution 155-2000 Be it resolved that the
Oswego Town Board corrects the appointment of Randall Pratt
as a member of the Zoning Board of Appeals to expire in February
2004. Moved by Supervisor Tyrie and seconded by Councilor Tierney.
4 ayes, 1 abstain. Mahaney, Mullen, Tierney, Tyrie aye, Pratt,
abstain.
Resolution 156-2000 Be it resolved the Oswego
Town Board authorizes the Dog Control Officer and the Assistant
Dog Control Officer to conduct a Town-wide Dog Census. Be it
further resolved that the Supervisor is authorized to compensate
said officials at the rate of $1.00 for each dog identified.
Moved by Supervisor Tyrie and seconded by Councilor Pratt. All
ayes motion carried.
Resolution 157-2000 Be it resolved that the Oswego
Town Board authorizes the attendance of the Highway Superintendent
at the 21st Conference of Highway Superintendents from September
19th through September 22nd. Be it further resolved that associated
costs shall be considered legitimate Town charges. Moved by
Councilor Tierney and seconded by Councilor Pratt. All ayes
motion carried.
Resolution 158-2000 Be it resolved that the
Oswego Town Board authorizes the Supervisor to sign a contract
with the Fruit Valley Animal Clinic. Be it further resolved
that such contract shall include the following: adjustment of
costs for boarding of large dogs from $7.00 to $8.00, for medium-sized
dogs from $6.00 to $7.00, and for small dogs from $5.00 to $7.00.
Moved by Councilor Mahaney and seconded by Councilor Tierney.
All ayes motion carried.
Resolution 159-2000 Be it resolved that the
Oswego Town Board authorizes the Dog Control Officer and Assistant
Dog Control Officer attend the "Investigating Animal Cruelty
Workshop", sponsored by the NYS Humane Society, on September
16, 2000. Be it further resolved that all associated costs shall
be considered legitimate town charges. Moved by Councilor Tierney
and seconded by Councilor Mullen. All ayes motion carried.
Resolution 160-2000 Be it resolved that the
Oswego Town Board accepts the appointment of Dorathy Brown to
serve as Clerk to the Town Supervisor. Moved by Supervisor Tyrie
and seconded by Councilor Mahaney. All ayes motion carried.
Agenda item I. Be it resolved that the Oswego
Town Board approves the appointment of ________to serve as Cemetery
Bookkeeper. Be it further resolved that position shall require
a total of 10 hours per week of attendance at Town Hall and/or
the Cemetery, at the discretion of the Town Supervisor and Cemetery
Superintendent. This item was put on hold.
Agenda item J. Be it resolved that the Oswego
Town Board approves the appointment of _______to serve as part-time
Clerk to the Town Supervisor's Office. This item was put on
hold.
Resolution 161-2000 Motion by Councilor Pratt
and seconded by Councilor Mahaney to move into executive session
to discuss pending litigation at 8:27 PM. 4 ayes, 1 nay.
Mahaney, Mullen, Pratt, Tyrie aye, Tierney nay.
Resolution 162-2000 Motion by Councilor Mahaney and
seconded by Councilor Tierney to resume the regular board meeting
at 8:50 PM. All ayes motion carried.
Public Comment: Town residents had questions
concerning adding items to the agenda during the meeting and
about the salary for the Clerk to the Supervisor. Further questions
regarding the board not answering during the public comment
part of the meeting. Has the board adopted Robert's Rules of
Order, capital-planning status and can the public speak during
board workshops and does the board respond? Correction to Resolution
140-2000 to insert "motion defeated". The town board
should be working together and stop fighting and give the public
answers to questions that are asked during the meeting stated
one public official. Councilor's Pratt, Tierney and Mullen responded
to people's concerns regarding the no comment request. Supervisor
Tyrie had further comments also. Recreation Director Theresa
Gibson had comments regarding the recreation program and some
problems she faced. The Community Center men's bathroom is still
out of order and will it be fixed by September when the seniors
return? Attorney Greene commented on the Carson Road situation.
Motion by Councilor Pratt and seconded by Councilor Mahaney
to adjourn the regular meeting at 9:05 PM. All ayes motion carried.
