The
regular meeting of the Town of Oswego Board was held at the
Southwest Community Center on January 3, 2000 at 7:00 PM. The
meeting was called to order by Supervisor Tyrie who opened with
the Pledge of Allegiance. Roll call was taken with the following
members present:

Resolution
1-2000 Motion by Councilor Tierney and seconded by
Councilor Mullen to amend Resolution 99-188 from 12/6/99 to
correct the vote of Councilor Tierney to aye.
Resolution 2-2000 Motion by Councilor Tierney
and seconded by Councilor Mullen to approve the minutes of 12/6/99
as amended. All ayes motion carried.
Resolution 3-2000 Motion by Councilor Mahaney
and seconded by Councilor Mullen to pay the bills for abstract
1 for the following amounts. All ayes motion carried.

Resolution 4-2000 Motion by Councilor Mahaney and seconded
by Councilor Pratt to amend abstract 12, general fund for $135.00
as a result of a refund. All ayes motion carried.
Town Clerk Report: The clerk gave the year-end
annual report stating that the Clerk’s Office took in
and disbursed $23,889.65. A brief description of the amounts
and various line items were explained. Notification was received
that Dr. Mary Walker has been accepted into the Women’s
Hall of Fame and a bus trip will be planned for anyone wishing
to attend the ceremony in Seneca Falls in October of this year.
Supervisor’s Report: Supervisor Tyrie
reported on the past year and the Board’s successes. The
meeting dates for the regular Board meeting, the Planning and
Zoning board were announced. There will be an informational
meeting scheduled February 3, 2000 at the Community Center to
discuss the Hojack Trail. He also noted that these are just
informational because the County has the final say on the Hojack
Trail. A meeting of the planning, zoning, code enforcement officers
and Board Members will be held February 10, 2000 at the Community
Center to discuss the roles of these departments. Committee
appointments were announced: the Chairs will stay the same as
last year. New this year will be staff meetings to be held at
the Town Hall. The first meeting is scheduled for January 27th
at 4:45 PM. A Town Board Workshop will be held January 26th
at Town Hall, 7 PM. Topics to be discussed are dog census, building
committee, sewer committee and highway contract.
Public Comment: Town residents Jim Thompson,
Barry Pritchard, Lori Costo had questions regarding the summer
recreation report, Hojack trail, ambulance contact and the light
for the flag at the community center. Mr. Thompson stated he
would like to continue as building chair but won’t until
the town establishes a capital-spending plan.
Unfinished Business: Councilor Mullen asked
about Carson Road. Attorney Greene answered her question. Attorney
Greene also wrote a letter to OCWA attorney to determine escrow
funds. He is waiting for further information. The Nunzi property
grant has not been determined yet. The Town should hear sometime
in January according to Senator Wright’s Office. Councilor
Mullen and Tierney would like to see the applications before
they decide on the positions in question. Councilor Tierney
had questions regarding North Star Boulevard. Attorney Greene
is working on getting answers for the Board.
New Business:
Resolution 5-2000 Be it resolved that the Oswego Town
Board authorizes the Supervisor to pay the salaries as identified
in Attachment A. Be it further resolved that the first payroll
of 2000 shall occur on January 6, 2000, and subsequent payrolls
shall occur on a biweekly/monthly basis (at the employees’
discretion) thereafter.
Moved by Councilor Tierney. Seconded by Councilor Mullen. Amend
list to read Court Attendant, Frank Novak at $51.50 per diem,
and Budget Preparation Salary to read, Budget Officer. All ayes
motion carried. See attachment A.
Resolution 6-2000 Be it resolved that Oswego
Town Board approves the following Employee Benefits Policy:
Any Town Employees or Town Officers who are considered to be
employed on a full-time basis with the Town shall receive the
health, dental, and retirement benefits specified in the current
Contract between the Town of Oswego and Teamster’s Local
317Full-time employees shall receive the sick/personal leave,
holidays, and vacations specified in said contract.Part-time
and seasonal employees and Town Officers shall be entitled,
at no cost to the Town; to participate in the health and dental
programs provided to full- time employees. Such employees shall
also be permitted to participate in the NYS Deferred Compensation
Plan. All costs associated with participation in any of these
benefits shall be borne by the Employee or Officer. Part-time
and seasonal Employees and Town Officers shall be offered the
option of participation in the NYS Retirement System, as provided
under the law. Motion by Councilor Tierney. Seconded by Councilor
Mullen. All ayes motion carried.
Resolution 7-2000 Be it resolved that the Oswego
Town Board approves the Appointments List for 2000, as identified
in Attachment B. Be it further resolved that such appointments
shall expire on December 31, 2000. Motion by Councilor Tierney.
Seconded by Councilor Mahaney. All ayes motion carried.
Resolution 7-2000-a Amend appointment list
for 2000 to remove the positions of Code Enforcement Officer,
Superintendent of Cemetery & Building, Clerk and Constable
until the board has enough time to review applications. 3 ayes,
2 nays.

Resolution

Resolution 8-2000 Be it resolved that the Oswego Town
Board approves the Town Travel Policy as found in Attachment
C. Motion by Councilor Mullen. Seconded by Councilor Mahaney.
All ayes motion carried. Councilor Tierney asked why the policy
had to be so technical. See attachment C.
Resolution 9-2000 Be it resolved that the
Oswego Town Board approves the Holiday Calendar as found in
Attachment D. Motion by Councilor Pratt. Seconded by Councilor
Mahaney. All ayes motion carried. See attachment D.
Resolution 10-2000 Be it resolved that the Oswego Town Board
approves the Code of Ethics as found in Attachment E with the
following change to item I and J to include member of the board.
Motion by Councilor Pratt. Seconded by Councilor Tierney. All
ayes motion carried.
Resolution 11-2000 Whereas the Town Clerk
is the Official responsible for providing emergency access to
Town records, therefore Be it resolved that the Oswego Town
Board approves the following policy regarding access to Town
records: All keys and combinations necessary for access to Town
records shall be provided to the Town Clerk’s Office within
seven days of installation. In the case of keys, a working copy
of the key shall be provided. When a combination lock is used,
a written description of the combination shall be provided.
When security is provided through the use of passwords or any
other method, steps shall be taken to ensure the ability of
the Town to access records during an emergency situation. Such
steps may include providing the necessary information to:
a. the Town Officer responsible for the records in question,
should the user be a Town employee or Contractor;
b. a fellow Town Officer, should the user be a Town Officer;
c. the Town Clerk in any situation.
In all cases, the password user is responsible for reporting,
in writing to the Town Clerk, the steps taken to ensure the
ability of the Town Clerk to access Town records in an emergency
situation. Motion by Supervisor Tyrie. Seconded by Councilor
Mahaney. All ayes motion carried.
Resolution 12-2000 Be it resolved that the
Oswego Town Board approves the Investment Policy as found in
Attachment F. Amend the wording Town of Scriba to Town of Oswego.
See attachment F. Motion by Councilor Tierney. Seconded by Councilor
Mullen. All ayes motion carried.
Resolution 13-2000 Be it resolved that the
Oswego Town Board approves the attendance of Town Board Members
Victoria Mullen, Barbara Tierney, Richard Pratt, and Jack Tyrie
Jr. at the Annual Meeting of the NYS Association of Towns. Be
it further resolved that all expenses associated with said meeting
shall be considered legitimate Town charges, provided all provisions
of Town policies are adhered to. Motion by Councilor Tierney.
Seconded by Supervisor Tyrie. All ayes motion carried.
Resolution 14-2000 Be it resolved that the
Oswego Town Board approves the contract for maintenance of the
Town Web site, such contract to be executed by the Supervisor
and Lisa Stevens as found in Attachment G-1. Motion by Councilor
Mullen. Seconded by Councilor Tierney. All ayes motion carried.
Resolution 15-2000 Be it resolved that the
Oswego Town Board approves the contract for animal boarding
and euthanasia, such contract to be executed by the Supervisor
and Fruit Valley Animal Clinic, as found in Attachment H. Motion
by Councilor Mullen. Seconded by Councilor Mahaney. All ayes
motion carried. See attachment H.
Resolution 16-2000 Be it resolved that the
Oswego Town Board approves the renewal of the contract for provision
of ambulance services to Town residents, such contract to be
executed by the Supervisor and the Mayor of the City of Oswego.Motion
by Supervisor Tyrie. Seconded by Councilor Pratt. All ayes motion
carried.
Councilor Pratt had questions regarding the contract and the
budget line item for this service. Supervisor Tyrie stated he
could check into private companies but felt they would be higher.
Resolution 17-2000 Whereas the State of NY
is providing state funds to assist in the operation of Justice
Courts, and Whereas Town Justice Roger Wells has identified
areas of need within the Oswego Town Court, Therefore Be it
Resolved that the Oswego Town Board supports the Justice Court
Assistance Program grant application to be submitted by Justice
Wells. Motion by Councilor Tierney. Seconded by Councilor Mullen.
All ayes motion carried.
Resolution 18-2000 Whereas the Supervisor traditionally
serves as the Town representative at the Annual Meeting of the
NYS Association of Towns, and
Whereas, in the absence of the Deputy Supervisor, the Senior
Town Board Member serves as the Alternate Representative to
said meeting, Therefore Be it resolved that the Oswego Town
Board designates Supervisor Jack Tyrie, Jr. to serve as Delegate
to the Annual Meeting of the NYS Association of Towns. Be it
further resolved that the Board designates Victoria Mullen to
serve as the Alternate Delegate to the same meeting. Motion
by Councilor Pratt. Seconded by Councilor Mahaney. All ayes
motion carried.
