The
regular meeting of the Town of Oswego Board was held at the
Southwest Community Center on June 12, 2000 at 7:03 PM. The
meeting was called to order by Supervisor Tyrie who opened with
the Pledge of Allegiance. Roll call was taken with the following

Town
Clerk's Report: The clerk reported $1162.50 was received
and disbursed for the month of May. There is a correction to
abstract #4 for $60.00 in general fund bringing the correct
total to $18,810.24. She made a bank transfer from the tax money
market account to the Supervisor 6/2/00 for $2776.89. This closes
out all tax accounts for the year 2000. The vital record books
have come back from the restoration company and 13 books have
been restored to date, with two books left which are the original
minute books. At the May conference in Saratoga she received
certification as a Registered Municipal Clerk, #101 in the State.
Also at the conference information regarding complaints were
discussed. Complaints are not available under the freedom of
information law. There will be free fishing days June 24 &
25. The rabies clinic for June will be held in Fulton June 21st
and June 28th in Oswego City from 6-8 PM. The county household
hazardous waste pick-up will be held June 24th, further information
is available in her office.
Resolution 95-2000 Be it Resolved that the
Oswego Town Board approves the minutes as presented by the Town
Clerk. Moved by Councilor Tierney and seconded by Councilor
Pratt. All ayes motion carried.
Resolution 96-2000 Be it Resolved that the
Oswego Town Board approves the audit of the bills for abstract
#6 and authorizes the payment of same by the Supervisor. Moved
by Councilor Mullen and seconded by Councilor Mahaney. All ayes
motion carried.

Supervisor's Report: The Supervisor reported
that he had received letters from Senator Wright's and Assemblywoman
Sullivan's office regarding our resolution on the speed limits
on town roads. He read a letter from David E. Fitch a representative
of Metropolitan Water Board regarding the water extension to
Hannibal. We had a wonderful Memorial Day Ceremony and he thanked
Mr. Pitcher and his crew for having the cemetery in good condition,
the Boy Scouts who attended and the Historical Society for their
help with the service.
Public Comment: Residents had questions regarding
the Community Center repairs, drainage problems on Perry Hill
Road which is causing extensive damage to private property and
questions and concerns with the Lakeshore Spur Road fence which
blocks residents from going down to the lake.
Unfinished Business:
Resolution 97-2000 Motion by Supervisor Tyrie to take
resolution 76-2000 from the table. Seconded by Councilor Mahaney.
All ayes motion carried.
Resolution 76-2000 Whereas the Town Land Use
Ordinance was passed in 1974, (revised in 1981), and Whereas
there are features of the law which, as demonstrated by legal
action against the Town and changes in New York State Laws and
Regulations, are in need of review, Therefore Be it Resolved
that the Oswego Town Board authorizes the Zoning Board of Appeals
to evaluate the Town Land Use Ordinance; Be It further resolved
that the Zoning Board of Appeals is hereby authorized to recommend
changes in the Land Use Ordinance, such alterations to include
the format, clarity, consistency, and enforcement of said Law,
but shall not be limited to said topics. Be it Further Resolved
that the Oswego Town Board hereby authorizes the Planning Board,
upon adoption of a Town Comprehensive Plan, to engage in a review
of the Land Use Ordinance, and to make recommendations for amendments
intended to bring such Ordinance into compliance with said Plan.
Moved by Supervisor Tyrie and seconded by Councilor Mahaney.
All ayes motion carried. Supervisor Tyrie read a letter from
Gary Miner, Chair of the Zoning Board of Appeals.
New Business:
Resolution 98-2000 Whereas the Oswego Town
Board wishes to encourage activities which build character,
emphasize positive contributions to the community, and respect
for self, and Whereas the Girl Scouts of America has a long
history of providing such direction and opportunity, and of
recognizing young women who demonstrate these ideals, Therefore
Be it Resolved that the Oswego Town Board commends Anne Sarkissian
on her receipt of the Girl Scouts of America Gold Award. Be
it Further Resolved that the Oswego Town Board applauds the
efforts which have resulted in this recognition. Be it Further
Resolved that the Oswego Town Board thanks her parents, Robert
and Sally Sarkissian and the many Girl Scout volunteers for
their contribution to Anne's achievement. Moved by Councilor
Mahaney and seconded by Councilor Tierney. All ayes motion carried.
Resolution 99-2000 Whereas the residents of
the Town of Oswego fund the salaries of Town Employees and Whereas
the Oswego Town Board believes that residents of the Town of
Oswego have added incentive to ensure that Town Government operates
in an efficient and productive manner, Therefore Be it Resolved
that the Oswego Town Board adopts the following policy:
The Town of Oswego is an Equal Opportunity Employer. The Town
does not discriminate on the basis of race, creed, gender, or
sexual orientation. Preference is given in hiring to individuals
who reside in the Town of Oswego, and to those who make a notarized
statement agreeing to relocate to the limits of the Town within
60 days of the date of hire. Be It Further Resolved that this
policy shall hereafter be known as the Robert Clary Rule, in
honor of the late Bob Clary's effort to promote the principles
underlying said policy.
Moved by Supervisor Tyrie and seconded by Councilor Mahaney.
Discussion followed.
Resolution 100-2000 Motion by Councilor Tierney
and seconded by Councilor Pratt to amend resolution 99-2000
by deleting the following line: "and to those who make
a notarized statement agreeing to relocate to limits of the
Town with 60 days of the date of hire". 4 ayes, 1 nay.
Mahaney, Mullen, Pratt, Tierney aye, Tyrie nay.
Resolution 101-2000 Whereas the Metropolitan
Water Board has transferred the balance of the escrow account
to the Town of Oswego, and Whereas said funds are intended for
purposes of water system expansion and improvement. Therefore
Be it Resolved that the Oswego Town Board directs the Supervisor
to reserve said funds in a C.D. separate from other Water District
funds until such time as the Board directs their use for the
purpose of town water system expansion and or improvement. Moved
by Councilor Pratt and seconded by Councilor Mullen. All ayes
motion carried.
Resolution 102-2000 Be it Resolved that the
Oswego Town Board authorizes the Supervisor to convene an Emergency
Planning Task Force. Moved by Councilor Tierney and seconded
by Councilor Mullen. All ayes motion carried.
Resolution 103-2000 Whereas the Oswego Town
Board wishes to encourage the children of our town to engage
in positive activities during the summer, and Whereas the Oswego
City-County Youth Bureau provides state assistance of 50% for
recreation programs, Therefore Be It Resolved that the Oswego
Town Board approves the calendar and budget as detailed in attachment
A. Moved by Councilor Mullen and seconded by Councilor Tierney.
All ayes motion carried.
Resolution 104-2000 Whereas Recreation Director
Theresa Gibson and Assistant director Elizabeth Weimer have
interviewed all applicants and Whereas they have made hiring
recommendations, Therefore Be it Resolved that the Oswego Town
Board authorizes the Supervisor to hire Katie Brown, Shannon
Palmer, Amy Smith, Eliot Austin, Shawna Opet, and Shawn Murphy
as summer counselors. Be it Further Resolved that they shall
be paid at a rate of $5.25 per hour. Moved by Councilor Mullen
and seconded by Councilor Mahaney. All ayes motion carried.
Resolution 105-2000 Whereas the Town of Oswego
has not altered building permit fees in recent memory and whereas
the cost of regulation construction has risen, and Whereas,
Code Enforcement Officer Dowd has recommended changes in the
structure of building permit fees, Therefore Be It Resolved
that the Oswego Town Board adopts the following fee schedule:
New Construction/Alteration/Repair/Addition:
One/Two Family Dwelling - $0.12/sq.ft.
Multiple Dwelling (Three or more units) - 0.18/sq.ft.
Manufactured Housing (No basement) - 80.00/unit
Manufactured Housing (with basement) - 115.00/unit
Accessory Buildings (inc.shed, pole barns,Detached garages,
less than 145 sq.ft. - 30.00/building
Accessory Buildings (inc.shed, pole barns,Detached garages,145
sq. ft. or larger, additional - 0.06/sq.ft.
Swimming pool - 30.00
Septic system w/new bldg.construction - 30.00
Septic system w/o new bldg.contruction - 30.00
Wood Stove/Chimney - 25.00

Be it Further Resolved that building permits shall expire one
year after the date of issue. Be it Further Resolved that building
permits may be renewed one time only, for a fee equal to 50%
of the original fee, provided renewal occurs within 60 days
of expiration. Moved by Supervisor Tyrie and seconded by Councilor
Mahaney. Discussion followed.
Resolution 106-2000 Motion by Councilor Tierney
and seconded by Councilor Pratt to table Resolution 105-2000.
All ayes motion carried.
Resolution 107-2000 Be it Resolved that the
Oswego Town board authorizes the Cemetery Superintendent to
hire Shawn Farnsworth and Eric Campbell as cemetery laborers
at a rate of $5.25 per hour. Moved by Supervisor Tyrie and seconded
by Councilor Mahaney. All ayes motion carried.
Resolution 108-2000 Be it Resolved that the
Oswego Town Board approves the following modifications to the
2000 General Budget:
i. transfer $1,710.17 from A3089 (State Aid) to A1462.1 (Vital
Statistics-Personal Services).
ii. Transfer $130.83 from A3089 (State Aid) to A9030.8 (Social
Security)
iii. Transfer $995.00 from A3089 (State Aid) to A1462.4 (Vital
Statistics-Contractual)
iv. Transfer $500.00 from A1990 (Contingency) to A1220.4 (Supervisor
Contractual)
Moved by Supervisor Tyrie and seconded by Councilor Mahaney.
Resolution 109-2000 Motion by Councilor Pratt
and seconded by Councilor Tierney to delete item iv. from Resolution
108-2000.
3 ayes, 2 nays. Mullen, Pratt, Tierney aye, Mahaney, Tyrie nay.
Resolution 110-2000 Be It Resolved that the
Oswego Town Board authorizes the Town Clerk to hire Nicki Murray
as part-time summer student for the clerk's office at $5.25
per. hour. Moved by Councilor Mahaney and seconded by Councilor
Tierney. All ayes motion carried.
Resolution 111-2000 Be it Resolved that the
Oswego Town Board authorizes the Supervisor to pay Health Insurance
payments as a pre-pay each month to insure proper payment deadlines
are met. Moved by Supervisor Tyrie and seconded by Councilor
Pratt. All ayes motion carried.
Resolution 112-2000 Be it Resolved that the
Oswego Town Board authorizes the performance of the Snowbelters
at the Oswego Town Park on June 21, 2000. Be it Further Resolved
that the Supervisor is authorized to make a payment of $100.00
performance fee. Moved by Councilor Mahaney and seconded by
Supervisor Tyrie.
Resolution 113-2000 Be it Resolved that the
Oswego Town Board authorizes the Supervisor to hire two student
clerks. Be it Further Resolved that said clerks shall be paid
$5.25/hr., and that the total number of hours for each shall
not exceed 10 hours/week. Moved by Supervisor Tyrie and seconded
by Councilor Mullen. 3 ayes, 2 nays. Mahaney, Mullen, Tyrie
aye, Pratt, Tierney nay.
Resolution 114-2000 Be it Resolved that the
Oswego Town Board authorizes the Supervisor to appoint Marsha
Echelbarger as new Planning Board Member. Term to expire 2/2003.
Motion by Supervisor Tyrie and seconded by Councilor Mahaney.
4 ayes, 1 nay. Mahaney, Mullen, Pratt, Tyrie aye, Tierney nay
Resolution 115-2000 Be it Resolved that the
Oswego Town Board authorizes the Supervisor to appoint Lee Phillips
as new Planning Board member. Term to expire 2/2006. Motion
by Councilor Tierney and seconded by Councilor Pratt. All ayes
motion carried.
Resolution 116-2000 Be it Resolved the Oswego
Town Board approves the following budget modification to transfer
$183.85 from A1990 (Contingency) to A1220.4 (Supervisor Contractual).
Motion by Councilor Mahaney and seconded by Councilor Pratt.
All ayes motion carried.
Public Comment: Residents had questions regarding
building permits and possible trailer violations.
Resolution 117-2000 Motion by Councilor Mullen
and seconded by Councilor Tierney to move into executive session
at 8:40 PM to discuss legal matters. 3 ayes, 2 nays. Mullen,
Pratt, Tierney aye, Mahaney, Tyrie nay,
Resolution 118-2000 Motion by Councilor Tierney
and seconded by Councilor Pratt to resume regular meeting at
8:50 PM. All ayes motion carried.
Resolution 119-2000 Motion by Councilor Pratt
and seconded by Councilor Mahaney to adjourn the regular meeting
at 8:51 PM. All ayes motion carried.
