The
regular meeting of the Town of Oswego board was held at the
southwest Community Center on October 16, 2000 at 7:00 PM. The
meeting was called to order by Supervisor Tyrie who opened with
the Pledge of Allegiance. Roll call was taken with the following
members present:

Supervisor
Tyrie asked everyone to remain standing in memory of the sailors
who lost their lives this past week and for the speedy recovery
for former Legislator Herb VanSchaack.
Resolution 2000-186 Be it resolved that the
Oswego Town Board approves modification of the 2000 general
town budget as follows: transfer $780.00 from A8020.4 planning
contractual to A1420.4 (attorney fee); $112.73 from A1620.13
(buildings labor) to A1660.4 (central storeroom); $32.00 from
A5010.4 (superintendent Highway contractual) to A13310.4 (traffic
control). Moved by Supervisor Tyrie and seconded by Councilor
Mahaney. All ayes motion carried.
Resolution 2000-187 Be it resolved that the
Oswego Town Board approves the minutes of 9/11, 9/28,10/4,10/11
and 10/12 as presented by the Town Clerk. Moved by Councilor
Tierney and seconded by Councilor Mahaney. All ayes motion carried.
Town Clerk's Report: The Historical Society
has Dr. Mary Walker postcards for sale and a few of the membership
went to Seneca Falls for the induction of Dr. Mary Walker in
the Women's Hall of Fame. The school days presentation will
be held again Oct. 22, 2000 at 1:00 PM at the Southwest Community
Center.
Supervisors Report: There will be an executive
session at the end of the regular meeting and no further business
will be conducted after that. The board is working on the budget
and further meetings will be held the next one on October 23rd
and October 30th at 5PM at the Southwest Community Center.
Public Comment: The resident's in attendance
had questions regarding: payroll, community center repairs,
agenda on web page, the state effective Jan. 2001 will raise
the ambulance fees, will the town have parking attendants for
general election. Also when will the budget be ready for the
public, value of broken computer, does Cavan Cove road meet
town's road specifications and does a PE need to sign off on
road.
Resolution 2000-189 Whereas the Town Planning Board
has approved the second phase of the Cavan Cove subdivision,
and Whereas the Town Highway Superintendent, in a letter dated
September 25, 2000, has certified that the extension of Cavan
Cove Road meets Town specifications, Therefore be it resolved
that the Oswego Town Board accepts the property identified as
the 965'extension of Cavan Cove Road as described on the survey
map prepared by John Damiano, LLS and dated November 30, 1999.
Be it further resolved that said road shall be defined as a
dedicated town road. Moved by Councilor Pratt and seconded by
Councilor Tierney. All ayes motion carried.
Resolution 2000-190 Be it resolved that the
Oswego Town Board approves the hiring of Jennifer Moon as Assistant
Clerk in the Town Supervisor's Office. Be it further resolved
that said appointment shall be compensated at a rate of $10.00
per hour, not to exceed 20 hours per week. Moved by Supervisor
Tyrie, seconded by Councilor Mahaney. 2 ayes, 3 nays. Mahaney,
Tyrie aye, Mullen, Pratt, Tierney, nay.
Resolution 2000-191 Be it resolved that the
Oswego Town Board shall hold a public hearing for the discussion
of Proposed Local Law 2000-3. Be it further resolved that such
hearing shall begin at 7:15 PM on Monday, November 13, 2000
at the Southwest Community Center. Moved by Supervisor Tyrie
and seconded by Councilor Tierney. All ayes motion carried.
Resolution 2000-192 Be it resolved that the
Oswego Town Board appoints Jon Vermilye to chair the Town Public
Hearing on renewal of the Cable Franchise agreement with Time-Warner,
Inc. Be it further resolved that such hearing shall be held
at the Southwest Community Center on Monday, November 20, 2000.
Said hearing shall commence at 7:00 PM. Moved by Supervisor
Tyrie and seconded by Councilor Mahaney. All ayes motion carried.
Resolution 2000-193 Whereas Walmart no longer
accepts vouchers for payment, Therefore be it resolved that
the Oswego Town Board authorizes the Town Supervisor to create
a charge account at Walmart. Be it further resolved that the
Supervisor, Clerk to Supervisor and Town Clerk shall be authorized
to use this account. All ayes motion carried.
Resolution 2000-194 Be it resolved that the
Oswego Town Board authorizes the Supervisor to purchase a replacement
computer. Be it further resolved that the Town board approves
the following budge modification; move $900.00 from A8020.4
planning contractual to A1220.4 supervisor contractual. Moved
by Supervisor Tyrie and seconded by Councilor Mahaney. 2 ayes,
3 nays. Mahaney, Tyrie aye, Mullen, Pratt, Tierney nay. Motion
failed.
Resolution 2000-195 Be it resolved that the
Oswego Town Board authorizes Steven Greene, Oswego Town Attorney,
to proceed formally with the collection of all expenses born
by the Town of Oswego and incurred in connection with the solicitation
of contributions for the purchase of the Nunzi property. Moved
by Councilor Tierney and seconded by Councilor Pratt. 4 nay,
1 present. Mahaney, Mullen, Pratt, Tierney nay, Tyrie present.
Motion failed.
Resolution 2000-196 be it resolved that the
Oswego Town Board approves the temporary appointment of Frank
Izyk as Assistant Cemetery Superintendent, such appointment
to expire on 12/31/2000. Moved by Supervisor Tyrie and seconded
by Councilor Mullen. All ayes motion carried.
Resolution 2000-197 Be it resolved that the
Oswego Town Board approves the appointment of Donalee Murray
as Zoning Board of Appeals secretary, such appointment to expire
on 12/31/2000. Moved by Supervisor Tyrie and seconded by Councilor
Mullen. All ayes motion carried.
Resolution 2000-198 Whereas Francis Dellamano
has devoted countless hours and untold effort toward planning
activities in the Town of Oswego, and Whereas the planning board
has come to rely upon Mr. Dellamano's experience and knowledge,
therefore be it resolved that the Oswego Town Board commends
Francis Dellamano for his 20+ years as a member of the Oswego
Town Planning Board. Moved by Councilor Mullen and seconded
by Councilor Pratt. All ayes motion carried.
Public Comment: Questions regarding the subdivision
book and that the planning board should review this, questions
regarding Nunzi property, why was Ms. Moon not hired, zoning
issues and complaints that were filed. Questions on Sleepy Hollow
Road, the cemetery backhoe.
Resolution 2000-199 Motion by Councilor Tierney
and seconded by Councilor Pratt to move into executive session
at 8:35 PM to discuss pending litigation and personnel matters.
All ayes motion carried.
Resolution 2000-200 Motion by Councilor Tierney
and seconded by Councilor Mahaney to resume the regular meeting
at 9:07 PM. All ayes motion carried.
Motion by Supervisor Tyrie and seconded by Councilor Mahaney
to adjourn the regular meeting at 9:08 PM. All ayes motion carried.
