The
regular meeting of the Town of Oswego Board was held at the
Southwest Community Center on September 11, 2000 at 7:00 PM.
The meeting was called to order by Supervisor Tyrie who opened
with the Pledge of Allegiance. Roll call was taken with the
following members present:

Resolution
2000-170 Be it resolved that the Oswego Town Board
approves modification of the 2000 general budget as follows:

$475.28 from A1990.4 (contingency) to A1220.4 (supervisor contractual)
$693.83 from A1990.4 (contingency) to A1420.4 (attorney contractual)
$198.78 from A1990.4 (contingency) to A1660.4 (central storeroom
contractual)
$35.30 from A1990.4 (contingency) to A3310.4 (traffic control
contractual)
$3246.00 from A1990.4 (contingency) to A4540.4 (ambulance contractual)

Resolution 2000-171 Be it resolved that the
Oswego Town Board approves the 8-14 & 8-28-00 minutes as
presented by the Town Clerk. Moved by Councilor Mahaney and
seconded by Councilor Pratt. Correction so noted on resolution
156-2000 in the 8-14-00 minutes to include Assistant Dog Control
Officer. All ayes motion carried.
Resolution 2000-172 Be it resolved the Oswego
Town Board approves the Town Clerk's audit and payment of the
following vouchers:

1 nay. Mahaney, Pratt, Tyrie aye, Mullen nay. Motion passed.
Town Clerk's Report: The Historical Society
will have a presentation on 9/14/00 at the Southwest Community
Center, 6:30 PM. It will be about the schools which were in
Oswego Town. A postcard of Dr. Mary Walker will be available
at the next Historical Society event on 10-5-00 at the Community
Center. Everyone is welcomed to come.
Supervisor's Report: There will be an executive
session at the end of the meeting. No further business will
be conducted after that. The board will have a budget workshop
on 9-14-00 at town hall, 5:00 PM. The recreation committee will
meet 9-12-00 at town hall
Public Comment: The residents in attendance
had questions regarding: payroll service for the town, the constables
and their current status, why the recreation committee staff
brought up the problem with court during recreation program.
Also of concern were the bookkeeping positions, the community
center repairs, and the dog obedience classes in the Highway
garage, Ontario Heights sewer district, code enforcement's cell
phone and the cemetery backhoe.
Resolution 2000-173 Be it resolved that the
Oswego Town Board authorizes the attendance of the Town Justices
and Court Clerks at the NYS Magistrates/Clerks School and conference
in Ellenville, NY from October 15th to 18th. Be it further resolved
that all associated costs shall be considered legitimate town
charges. Be it further resolved that such cost shall include
$50.00 and $20.00 pre-registration fees for Justices and clerks
respectively, and $121.00 per person, per day for meal and lodging
costs. Moved by Councilor Pratt and seconded by Councilor Mullen.
All ayes motion carried.
Resolution 2000-174 Be it resolved that the
Oswego Town Board authorizes the Supervisor to sign the Application
for fire hydrants, to be located on Cavan Cove. Be it further
resolved that costs of such work shall be borne by Donald G.
and Patricia I. Pritchard, the developers of Cavan Cove. Moved
by Supervisor Tyrie and seconded by Councilor Mahaney. All ayes
motion carried.
Resolution 2000-175 Be it enacted that the
Oswego Town Board approves the grammatical and legal changes,
in Local Law 1 of the year 2000, such changes being of a technical
nature which do not alter the meaning or intent of the Law.
Be it further resolved that such changes are represented in
attachment A. Moved by Councilor Mahaney and seconded by Councilor
Mullen. All ayes motion carried.
Resolution 2000-176 Whereas the problems resulting
from sprawl, failure of infrastructure to keep pace with development,
and loss of open space are regional in nature, and Whereas the
Town of Oswego Planning Board has a vital role to play in answering
questions related to such problems and Whereas the Oswego Town
Board recognizes that responsible, long-range planning practices
are of benefit to Town Residents, be it resolved that the Oswego
Town Board joins with the American Institute of Certified Planners
and the American Planning Association in declaring November
8, 2000 to be World Town Planning Day in the Town of Oswego.
Be it further resolved that the Oswego Town Board directs the
Supervisor to take appropriate steps to recognize the role of
the Town Planning Board. Moved by Supervisor Tyrie and seconded
by Councilor Mahaney. All ayes motion carried.
Resolution 2000-177 Be it resolved that the
Oswego Town Board approves the attendance of Planning Board
and Town Board members at the Waterfront Rediscovery Conference
in Albany on September 26th and 27th. Be it further resolved
that the Oswego Town Board approves that associated charges,
including a $35.00 per person registration fee, shall be considered
legitimate town charges. Moved by Supervisor Tyrie and seconded
by Councilor Mahaney. All ayes motion carried.
Item F. Be it resolved that the Oswego Town
Board approves the application to the Oswego County Decentralization
Grant Program. Was pulled from agenda.
Resolution 2000-178 Whereas the NYS Comptroller's
Office recommends that the duties of cash management should
be separated from bookkeeping duties, and Whereas such separation
ensures greater accountability to the taxpayer, and security
of town funds, and Whereas such a division of duties can be
accomplished without increased cost to the taxpayer, therefore
be it resolved that the Oswego Town Board approves amending
the duties of the Assistant Clerk assigned to the Supervisor's
office as follows: employee shall be responsible for all bookkeeping
tasks, financial reporting requirements, and banking reconciliation
of the Town of Oswego. Employee shall also be responsible for
clerical tasks associated with the Rural Cemetery, and when
time permits assist with the duties of the Clerk to the Supervisor.
Be it further resolved that said position shall be paid at a
rate of $10.00/hour, and shall not exceed 25 hours/week. Be
it further resolved that the stipend for Cemetery Bookkeeper
shall be used as partial funding of the position. Be it further
resolved that the Town Supervisor is authorized to request the
involvement of the County Personnel Department in determining
job title, classification and testing procedures required to
produce qualified applicants for said position. Moved by Supervisor
Tyrie and seconded by Councilor Mahaney. 2 ayes, 2 nays. Mahaney,
Tyrie aye, Mullen, Pratt nay. Motion failed.
Resolution 2000-179 Be it resolved that the
Oswego Town Board shall hold a public hearing for the discussion
of Proposed Town Law 3-2000. Be it further resolved that such
hearing shall begin at 7:15 PM on Monday, October 16th at the
Southwest Community Center. Moved by Supervisor Tyrie and seconded
by Councilor Mullen. All ayes motion carried.
Resolution 2000-180 Whereas the Town of Oswego
has equipment and materials which are no longer of use to the
Town, and Whereas there has been an insufficient effort to keep
track of the disposal of such equipment and materials, and Whereas
said equipment and materials may be of some value on the market.
Therefore be it resolved that the Oswego Town Board directs
the Supervisor to conduct a survey of Town Officials and Employee
for the purpose of identifying the manner in which Town equipment
and materials are discarded, and to identify all such property
which is in the Town's Possession. Be it further resolved that
the Supervisor shall research the methods of disposal, which
may generate revenue for the Town. Moved by Councilor Mahaney
and seconded by Supervisor Tyrie. All ayes motion carried.
Friendly amendment as follows: No town equipment or property
shall be discarded without approval of the Town Board.
Resolution 2000-181 Be it resolved that the
Oswego Town Board accepts with regret the resignation of Court
Clerk, Shirlie Stuart. Be it further resolved that the Town
Board thanks Mrs. Stuart for more than a decade of service to
the Town of Oswego. Moved by Councilor Mullen and seconded by
Councilor Pratt. All ayes motion carried.
Resolution 2000-182 Be it resolved that the Oswego
Town Board approves the appointment of Patricia Jung to serve
as Court Clerk. Moved by Councilor Mullen and seconded by Councilor
Mahaney. Three ayes, 1 Present. Mahaney, Mullen, Pratt aye,
Tyrie present.
Resolution 2000-183 Whereas the Oswego Town
Board wishes to encourage the development of young people with
strong character and high ideals, be it resolved that the Oswego
Town Board commends Nicholas Fernandes on achieving the rank
of Eagle Scout. Be it further resolved that the Oswego Town
Board extends it's thanks to Mr. & Mrs. Fernandes, his parents,
for their contribution to the Oswego Town Community, and The
Oswego Town Board also extends it heartfelt gratitude for the
flagpole at the Southwest Community Center which served as Scout
Fernandes Eagle Scout Project. Be it further resolved that the
Oswego Town Board also acknowledges the contribution of Scout
Master Rick Fernandes of Scout Troop 891 for his continued good
work. Moved by Supervisor Tyrie and seconded by Councilor Mullen.
All ayes motion carried.
Public Comment: The residents in attendance
had questions regarding the court clerk's salaries, inventory,
the budget and new buildings, county planning and the capital
planning deadline. Further questions regarding Nunzi's, the
dog obedience classes, and an announcement that pet food is
being collected at Malone's garage for seniors who cannot afford
to feed their pets.
Resolution 2000-184 Motion by Councilor Mullen
and seconded by Councilor Pratt to move into executive session
to discuss pending litigation at 9:20 PM. All ayes motion carried.
Resolution 2000-185 Motion by Councilor Mullen
and seconded by Councilor Mahaney to resume the regular meeting
at 9:35 PM. All ayes motion carried.
Motion by Councilor Mahaney and seconded by Councilor Mullen
to adjourn the regular meeting at 9:37 PM. All ayes motion carried.
