The
organizational meeting of the Oswego Town Board was held at
the Southwest Community Center on January 8, 2001 at 7:00 PM.
The meeting was called to order by Supervisor Tyrie who opened
with the Pledge of Allegiance. Roll call was taken with the
following members present:

Public
Comment: Questions were raised regarding the community
center repairs, budget transfers, court officer salaries, ambulance
contract, Carson Road, Attorney appointment and salary and constable
appointment
Supervisor's Report: There are further budget
modifications for the 2000 budget and the highway budget modifications
have not been calculated yet and will not be reflected in the
resolution.
Resolution 2001-1 Be it resolved that the
Oswego Town Board modifies the 2000 General Budget as follows:
Transfer $7.00 from A7145.4 (joint recreation) to A1410.4 (Town
Clerk contractual); and $1595.00 from A 7020.4 (recreation administration)
to A1420.4 (attorney); and $2200.00 from A7310.1 (youth programs-personal
services) to A1620.4 (buildings contractual); and $500.00 from
A7140.4 (playgrounds contractual) to A1650.4 (central communications);
and $945.00 from A5182.4 (street lighting) to A1660.4 (central
storeroom); and $1915.00 from A5182.4 (street lighting to A4540.4
(ambulance); and $1300.00 from A1910.4 (unallocated insurance)
to A3120.1 (police-personal services); and $2950.00 from A9060.8
(medical insurance) to A8020.4 planning contractual.
Moved by Supervisor Tyrie and seconded by Councilor Pratt. All
ayes motion carried.
Supervisor's Report continued: A local contractor has looked
at the Community Center and will report to the board. Seaway
Trail is interested in the Community Center building. State
may help with the building. Dog obedience classes and where
they can be held will be discussed with the board for next meeting.
A workshop in February will be held to have further discussion
on the "Junk Law". January 8, 2001
The city has been notified that a meeting is needed to discuss
the ambulance contract. OCWA has been contacted regarding rental
of town hall office space. Supervisor Tyrie would like to meet
with County Officials to discuss the collection of the sales
tax.
On January 22, 01 a meeting of the emergency planning will be
held at the Town Fire Barn. An executive session will follow
the final public comment section with no further board action
being taken.
Resolution 2001-2 Be it resolved that the
Oswego Town Board establishes a Supervisor's Office Petty Cash
fund of $100.00. Moved by Supervisor Tyrie and seconded by Councilor
Mahaney. All ayes motion carried.
Town Clerk's Report: The annual receipts for
2000 for the clerk's office is $24983.20, December receipts
total $578.00. Total Tax collection to date is $150,962.66.
All dogs need to be tied up until April 30, 2001. Drivers are
needed for the senior Meals on Wheels program please volunteer.
Thank you to all of the town employees who donated to the Town's
secret Santa projects

Councilor Tierney and seconded by Councilor Mullen. All ayes
motion carried.
Resolution 2001-4 Be it resolved that the Oswego
Town Board approves the minutes of the 12/11/00 and 12/28/00
meetings as submitted by the Town Clerk. Moved by Supervisor
Tyrie and seconded by Councilor Tierney. All ayes motion carried.
Resolution 2001-5 Be it resolved that the
Oswego Town Board establishes a Town Clerk's Petty Cash fund
of $100.00. Moved by Councilor Mahaney and seconded by Councilor
Pratt. All ayes motion carried.
Resolution 2001-6 Be it resolved that the
Oswego Town Board authorizes the payment of 2001 salaries as
identified in Attachment A. Friendly amendments: amend Clerk
to Supervisor salary from hourly to salary, delete Clerks' salary,
change Community Center set-up salary to $8.32 hour, Planning
and Zoning board hearings and town authorized special meetings
$15.15 per hearing/meeting. Motion by Councilor Mahaney and
seconded by Councilor Pratt. All ayes motion carried.
Resolution 2001-7 Be it resolved that the
Oswego Town Board approves the appointments of Town Employees
and Officials as identified in Attachment B. Moved by Councilor
Mullen and seconded by Councilor Mahaney. Friendly amendments:
Amend as follows: Delete Court Attendant from list, add 60 day
provisional to Donald Dowd appointment. All ayes motion carried.
Resolution 2001-8 Be it resolved that the
Oswego Town Board will hold the regular meetings of the Town
Board on the 2nd Monday of each month with exceptions of holidays
when meeting shall be held on the 3rd Monday of the month. Motion
by Councilor Mahaney and seconded by Councilor Pratt. All ayes
motion carried.
Resolution 2001-9 Be it resolved that the
Oswego Town Board heretofore reaffirms all policies in effect
on December 31, 2000 for the year 2001. Motion by Supervisor
Tyrie and seconded by Councilor Mahaney. 4 ayes, 1 nay. Mahaney,
Mullen, Tierney, Tyrie aye, Pratt nay.
Resolution 2001-10 Be it resolved that the
Oswego Town Board approves moving to a semi monthly payroll
calendar for all salaried employees such payrolls to be made
beginning on the 30th of January following on the 15th and 30th
of the month thereafter. Motion by Supervisor Tyrie and seconded
by Councilor Pratt. All ayes motion carried.
Resolution 2001-11 Be it resolved that the
Oswego Town Board authorizes the Town Supervisor to enter into
the copier maintenance agreement submitted by Craig Gilbert
(Attachment C). Moved by Supervisor Tyrie and seconded by Councilor
Mullen. All ayes motion carried.
Resolution 2001-12 Be it resolved that the
Oswego Town Board authorizes the Town Supervisor to enter into
the website maintenance agreement submitted by Lisa Stevens
for $2400.00 from January 1, to December 31, 2001. Moved by
Councilor Pratt and seconded by Councilor Mullen. All ayes motion
carried.
Resolution 2001-13 Be it resolved that the
Oswego Town Board appoints Jack Tyrie, Jr. and Deputy Supervisor
Margaret Mahaney to serve as Delegate and Alternate Delegate
to the 2001 Annual Meeting of the Association of Towns. Moved
by Councilor Mullen and seconded by Councilor Tierney. All ayes
motion carried.
Resolution 2001-14 Motion by Councilor Tierney
and seconded by Councilor Mullen to move into executive session
at 8:30 PM to discuss pending litigation. All ayes motion carried.
Resolution 2001-15 Motion by Councilor Tierney
and seconded by Councilor Pratt. BE IT RESOLVED, by the Town
Board of the Town of Oswego, Oswego County, New York, on the
8th day of January 2001, as follows:
1. That to protect the real property rights of Town of Oswego
residents and to enforce the ordinances hereinbefore adopted
by the Town of Oswego intended to protect the interests of residents
living within residential zones, the Law Offices of Stephen
C. Greene is hereby authorized to bring a New York State Supreme
Court action in an effort to obtain injunctive relief against
Thomas K. Irwin and/or Ruth Irwin and/or the Estate of Carl
V. Irwin, to cease an alleged expansion of a non-conforming
commercial business use of premises located upon 413 Cemetery
Road, Oswego, New York and the lands appurtenant thereto.
2. This resolution shall take effect as of January 9, 2001 nunc
pro tunc.

Resolution 2001-16 Motion by Councilor Tierney
and seconded by Supervisor Tyrie to resume the regular meeting
at 9:40 PM. All ayes motion carried. Motion by Supervisor Tyrie
and seconded by Councilor Mahaney to adjourn the regular meeting
at 9:41 PM.
