The
regular meeting of the Oswego Town Board was held at 7:00 PM
at the Southwest Community Center. The meeting was called to
order by Supervisor Tyrie who opened with the Pledge of Allegiance.

Public
Comment: Resident's had questions and concerns regarding
renting a backhoe for the cemetery, the town park drainage problem,
and praise was given to Councilor Pratt for his resolution on
payment of bills. The board addressed the problem of the drainage
and will meet with Mr. Pelton after the public hearing on May
21, 2001 at the Southwest Community Center around 8:00 PM. Senior
Citizen President Olin Pritchard gave a report regarding area
Senior Citizen Clubs that the board asked for last month. Rates
and membership qualifications vary. The Town Clerk will copy
and distribute copies to the Town Board.
Supervisor Report: The new town web site is
www.townofoswego.com. He will also be holding an informational
meeting sometime in June with the resident's of Sleepy Hollow.
Board members are asked to contact him with dates they are available.
Resolution 2001- 81 Be it resolved that the
Oswego Town board approves the following modification to the
2001 Sleepy Hollow Sewer District Budget: Move $15,000.00 from
the unallocated surplus to SS1-9730.6 Principal. Moved by Supervisor
Tyrie and seconded by Councilor Mahaney. All ayes motion carried.
Resolution 2001- 82 Be it resolved that the
Oswego Town Board approves the following modification to the
2001 General Budget: Move $400.00 from A1990.4 contingency to
A9050.8 unemployment insurance. Moved by Supervisor Tyrie and
seconded by Councilor Pratt. Discussion followed, friendly amendment
to change $400.00 to required amount up to $225.00. All ayes
motion carried.
Resolution 2001- 83 Be it resolved that the
Oswego Town Board approves the minutes of the April 9, 2001
meeting, as submitted by the Town Clerk. Moved by Councilor
Tierney and seconded by Councilor Mullen. All ayes motion carried.
Resolution 2001- 84 Be it resolved that the Oswego
Town Board approves the bills on abstract 5, and authorizes
the Supervisor to pay the following vouchers:

Councilor Tierney and seconded by Councilor Mahaney. All ayes
motion carried.
Town Clerk's Report: On May 2, 2001 $702.43
was paid to the Supervisor which represents April fees, total
collected for the month was $1008.50. The town clerk's office
participated in the Earth Day re-cycling and the highway department
brought 240 pounds of shredded paper to the transfer station.
Thank you to Mr. Carter's department, the Assessor's Office,
Supervisor's office and deputy town clerk for helping and participating
in this county event. The final tax payment to the Supervisor
was made April 12, 2001, $2008.67 which represents March bank
interest, $2802.88 which represents February, March and April
penalties. The County Treasurer was paid $983,393.43 on April
12, 2001. The Historical Society will hold a Memorial Service
in Rural Cemetery on May 28, 2001 at 10AM.
Old Business:
Recreation Committee Report: Councilor Mullen thanked
everyone who helped with the Easter Egg Hunt , especially Rick
Hogan and Butch Ponzi. Emerald Mist has offered to donate 3
trees for the park, the 3 dead evergreen trees were taken down
by the County. Thank you to the County and Town Highway Departments.
Highway Committee Report: The Highway advisory
committee has been meeting and are getting closer to recommending
to the Town Board possible plans. They have met with many local
contractors and have contacted the DEC.
New Business:
Resolution 2001- 85 Be it resolved that the
Oswego Town Board authorizes the SUNY Oswego CSEA to use a town
voting machine for the purpose of holding their 2001 elections.
Moved by Councilor Mullen and seconded by Councilor Mahaney.
All ayes motion carried.
Resolution 2001- 86 Be it resolved that the
Oswego Town Board approves the use of the Cemetery Receipt Form
(attachment A) and the Cemetery Deed Form (attachment B). Moved
by Supervisor Tyrie and seconded by Councilor Mahaney. Friendly
amendment to remove fees from receipt form. All ayes motion
carried.
Resolution 2001- 87 Whereas the estimates submitted
for the purchase of a back hoe for the cemetery were not in
fact "state bids" and whereas the town of Oswego must
follow General Municipal Law 103 when a purchase is made without
a state bid price, therefore be it resolved that the Oswego
Town Board rescinds Resolution 2001-71. Moved by Councilor Mullen
and seconded by Councilor Tierney. All ayes motion carried.
Resolution 2001- 88 Be it resolved that the
Oswego Town Board authorizes the Town Supervisor to advertise
for bids on the purchase of a back hoe as described in the specifications
submitted by the Rural Cemetery Superintendent (attachment C).
Be it further resolved that such bids shall be opened at 4:00
PM on June 4, 2001. Moved by Councilor Tierney and seconded
by Councilor Mahaney. Discussion followed. Delete name of tractor
on bid spec document for the newspaper, add minimum 43 horsepower
to spec's. All ayes motion carried.
Resolution 2001- 89 Be it resolved that the
Oswego Town Board honors Timothy Hetzer for his heroic rescue
of Steve Pyne. Moved by Supervisor Tyrie and seconded by Councilor
Mahaney. All ayes motion carried.
Resolution 2001- 90 Be it resolved that the
Oswego Town Board approves the settlement of the LL Harbor Assessment
Case (attachment D). Moved by Councilor Tierney and seconded
by Councilor Mahaney. All ayes motion carried. Complete resolution
in town clerk 's minute book.
Resolution 2001- 91 Be it resolved that the
Oswego Town Board authorizes the 2nd Annual Memorial Day Remembrance
Ceremony to be held in conjunction with the Oswego Town Historical
Society. Moved by Supervisor Tyrie and seconded by Councilor
Mullen. All ayes motion carried.
Resolution 2001- 92 Be it resolved that the
Oswego Town Board authorizes Town Clerk Theresa A. Cooper, to
serve as a Marriage Officer. Be it resolved that such appointment
shall run concurrently with the Term of Office of the Town Clerk.
Moved by Supervisor Tyrie and seconded by Councilor Mullen.
All ayes motion carried.
Resolution 2001-93 Be it resolved that the
Oswego Town Board schedules a public hearing on Proposed Local
Law 2001-4, such proposed law adopting the changes made by FEMA
in the Town's flood plain maps. Be it resolved that such hearing
shall be held on June 11, 2001, at 7:05 PM at the Southwest
Community Center. Moved by Supervisor Tyrie and seconded by
Councilor Pratt. All ayes motion carried.
Resolution 2001- 94 Be it resolved that the
Oswego Town Board approves the hiring of Sean Farnsworth, Ryan
Polky, John Knopp, Joe Susino, and Don Dowd III as summer cemetery
employees. Moved by Councilor Mullen and seconded by Councilor
Tierney. All ayes motion carried.
Resolution 2001- 95 Be it resolved that the
Oswego Town Board authorizes the Supervisor to sign the Proposed
Cable Television Franchise Agreement with Time-Warner Inc. (attachment
E). Be it further resolved that the Oswego Town Board extends
its appreciation to Jon Vermilye for all the time and effort
he has devoted to developing said agreement. Moved by Supervisor
Tyrie and seconded by Councilor Pratt. All ayes motion carried.

Resolution 2001- 96 Whereas, Section 125,
subsection 2 of the Town Law of the State of New York requires
the "(t) he Supervisor shall render to the town board at
the end of each month a detailed statement of all money received
and disbursed by him for such month, and shall file a copy in
the office of the town clerk" and Whereas, the Town Board
is obligated, pursuant to section 119 of said Town Law, to audit
claims and direct payment by warrant of only those funds which
are available for expenditure from the treasury of the Town,
and Whereas, the availability of such funds can be determined
only upon receipt and review of the Supervisor's detailed statement
of all money received and disbursed by him as required by the
aforesaid section of the Town Law, and Whereas no such monthly
statement of the Supervisor has been rendered for the months
of February, March or April, of 2001. Now, therefore, be it
resolved that no consent to the disbursement of funds of the
Town of Oswego, New York, shall be given until the rendering
of such detailed statements to the Town Board filing of same
with the Town Clerk has occurred; and be it further resolved,
that if such detailed statements are not so rendered and filed
within ten (10) days of this resolution's date, a copy of this
resolution shall be transmitted to the Comptroller of the State
of New York for advisement and action. Moved by Councilor Pratt
and seconded by Councilor Tierney. Discussion followed, friendly
amendment to delete February. 3 ayes, 2 nays. Mullen, Pratt,
Tierney, Aye, Mahaney, Tyrie, Nay.
Resolution 2001- 97 Be it resolved that the
Oswego Town Board approves following expenditures associated
with the Oswego Seniors: 6/27/01 Olean trip $950.00 8/23/01
Poconos 575.00 Moved by Councilor Tierney seconded by Councilor
Mullen. All ayes motion carried.
Resolution 2001- 98 Be it resolved that the
Oswego Town Board approves the settlement of Oswego Town vs.
Irwin as presented by Attorney Steven Greene Jr. (attachment
F). Moved by Councilor Mullen seconded by Councilor Mahaney.
All ayes motion carried. Complete copy in town clerk's minute

Public Comment: Resident's had questions and
concerns regarding the resolution of payment of bills and account
balances, when is the public hearing on the cell tower, FEMA
maps, cable fees, senior citizens money, and is there any further
information on the repair of the Community Center?
Motion by Councilor Tierney and seconded by Councilor Mullen
to adjourn the regular meeting at 8:45 PM.
