The
regular meeting of the Oswego Town Board was held on April 8,
2002 at the Southwest Community Center. Supervisor Mullen opened
with the Pledge of Allegiance at 7:00 PM. Roll call was taken
with the following members present:

The meeting
was opened at 7:10 PM for the public hearing.
Resolution 2002- 56 Be it resolved that the Oswego Town
Board opens the Public Hearing on Proposed Local Law 2002-2,
Home Improvement Exemption to Lower Property Taxes (HELP), a
tax deferment plan. Moved by Supervisor Mullen and seconded
by Councilor DeSacia. All ayes motion carried.
County Legislator Doug Malone spoke in favor of this local law.
No one spoke against this law.
Resolution 2002- 57 Be it resolved that the Oswego Town
Board closes the Public Hearing on Proposed Local Law 2002-2
at 7:13 PM. Moved by Supervisor Mullen and seconded by Councilor
Tierney. All ayes motion carried.
Town Clerk Report: The truck bids received were read,
one bid for $800.00, 2 bids for $300.00. The March town clerk
money received was $1328.00 with $1136.28 paid to the Supervisor.
Public Comment: Comments and concerns from the residents
were as follows: what is the cost of the new highway garage,
how much do we pay website person, it's too much, ZBA problems
with operating a business with deck, owner wants help from the
town to resolve this problem. Was an environmental impact study
done at Sleepy Hollow?
Supervisor's Report: The Supervisor reported that efforts
are being made to comply with the DEC order for Sleepy Hollow,
she met with the Sewer Tender and discussed job description
and weed problems in settling beds. All the manholes have been
found and work will be done to raise them. Thank you to Leon
Carter and his employees who helped find the manhole covers,
and to Mr. & Mrs.Tim DeSacia and Charlie Mullen who worked with
me to clean out the settling beds in Sleepy Hollow.
Our former cemetery superintendent has quit and a provisional
appointment has been made thus far.
Ontario Heights residents will be receiving a letter next week
to explain the sewer usage fee increase from the City of Oswego.
Final approval from the State agencies concerning a no cost
extension for the 1997 $50,000.00 Sleepy Hollow Treatment Grant
has been received.
Paperwork has been completed for the last year Youth Recreation
Program. The Town will receive reimbursement of $8492.00 for
2001 for the program.
The Highway garage panel met with the architect and engineer
and final plans will be ready soon to present to the public.
Councilor Mahaney met with the Planning and Zoning Boards and
reported at the board workshop their suggestions. There will
be a panel set up to review zoning in the town, and we are asking
for two volunteers from the public to be on this panel. Please
contact Mrs. Mahaney if you would like to serve. I am working
with Karen Noyes from the Oswego County Planning to finish the
comprehensive plan. This plan must be finalized and be in place
for the town to re-evaluate our zoning.
The town has received notification that the Pease home has been
listed on the National Register of Historic Places. The Pease
home was a stop on the Underground Railroad. The third annual
Easter Egg hunt was a huge success. Thank you to Rick and Debbie
Hogan, Butch Ponzi, and Theresa Cooper for their help with this
event. We hope to make it bigger and make improvements next
year.
Mrs. Cooper noted that it was a great pleasure as town clerk
to play the part of the Easter Bunny. The children were wonderful.
Resolution 2002- 58 Be it resolved that the Oswego Town
Board approves the minutes from the March 11, 2002 Town Board
meeting. Moved by Councilor Mahaney and seconded by Councilor
Tierney. All ayes motion carried.
Resolution 2002- 59 Be it resolved that the Oswego Town
Board approves the bills on abstract 4.

motion carried.
Resolution 2002- 60 Be it resolved that the Oswego Town
Board approves the attendance of the Supervisor to the New York
State Comptrollers April session of Advanced Accounting School,
and the Town Clerk and Supervisor's Clerk to attend the June
Session. Be it further resolved that the Highway Superintendent
will attend the Highway School at Ithaca College the first week
in June. Be it further resolved that all associated costs shall
be considered legitimate town charges. Moved by Supervisor Mullen,
seconded by Councilor Pratt. All ayes motion carried.
Resolution 2002- 61 Be it resolved that the Oswego Town
Board appoints Randall Pratt as Chairman of Zoning Board of
Appeals. Term to expire 12/31/02. Moved by Supervisor Mullen
and seconded by Councilor DeSacia. 4 ayes, 1 abstain DeSacia,
Mahaney, Mullen, Tierney, aye. Pratt abstain
Resolution 2002- 62 Be it resolved that the Oswego Town
Board appoints Kenneth Kern to the Planning Board. Term to expire
2/2007. Moved by Supervisor Mullen, seconded by Councilor Tierney.
All ayes motion carried.
Resolution 2002- 63 Be it resolved that the Oswego Town
Board gives final approval for the Highway Superintendent to
purchase a 2002 Dodge Ram 2500 ¾ ton 4 door quad cab pickup
truck the amount not to exceed the State Bid of $24729.00. Discussion
followed, friendly amendment as follows: approve a 2 door regular
cab pickup truck, the amount not to exceed $19201.00. Moved
by Councilor Pratt, seconded by Councilor DeSacia.
Resolution 2002- 64 Be it resolved that the Oswego Town
Board approves the following polling sites for the year 2002.
District 1 Hall-Newman Center District 2 Oswego Town Fire Station
District 3 Southwest Community Center District 4 Hewitt Union
Moved by Supervisor Mullen and seconded by Councilor Pratt.
All ayes motion carried.
Resolution 2002- 65 Be it resolved that the Oswego Town
Board sets the following salaries:
Cemetery Laborer $5.30 + 2yrs.$5.81
Assistant Cemetery Superintendent $7.08
Recreation Director $9.09
Assistant Recreation Director $7.07
Youth Program Counselor $5.30
Clerk to Supervisor $18720.00 per year
Moved by Supervisor Mullen and seconded by Councilor Tierney.
All ayes motion carried.
Resolution 2002- 66 Be it resolved that the Oswego Town
Board approves the Superintendent of Highway agreement as per
attachment. Moved by Councilor Tierney and seconded by Councilor
Pratt. All ayes motion carried.
Resolution 2002- 67 Be it resolved that the Oswego Town
Board rejects all bids received for the 1989 and 1994 pick up
trucks. Moved by Supervisor Mullen and seconded by Councilor
Mahaney. All ayes motion carried.
Resolution 2002- 68 Moved by Councilor Tierney and seconded
by Councilor Pratt to adopt The Town of Oswego Stormwater Management
and Erosion Control Ordinance.
Whereas, the Town Board of the Town of Oswego, New York,
has duly deliberated and considered the needs of the Town of
Oswego, New York, as set forth in the annexed instrument and
the means to meet said needs in accord with its authority under
the Laws and Constitution of the State of New York, and
Whereas, the annexed instrument as above entitled appears
to satisfy the needs of said Town and promote the property,
affairs and government thereof,
Now, Therefore be it
Resolved, that the Town Board of the Town of Oswego,
New York, hereby adopts the above-entitled legislation to become
effective as set forth in the said annexed instrument or as
may otherwise be provided.

Resolution 2002- 69 Moved by Supervisor Mullen and seconded
by Councilor DeSacia to adopt Local Law 2002-1 Town of Oswego
Sewer Use Law.

Resolution 2002- 70 Be it resolved that the Oswego Town
Board adopts Local Law 2002-2, Home Improvement Exemption to

Resolution 2002- 71 Be it resolved that the Oswego Town
Board approves the hiring of WD Malone Trucking and Excavating
to raise 12 sanitary manholes to finish grade at Sleepy Hollow.
Price not to exceed $12,500.00. Moved by Councilor DeSacia,
seconded by Councilor Pratt. All ayes motion carried.
Motion by Councilor Tierney and seconded by Councilor Mahaney
to close the regular meeting at 7:50 PM. All ayes motion carried.
