TOWN OF OSWEGO, OSWEGO COUNTY, NEW YORK

RESOLUTION AND ORDER

RESOLUTION AND ORDER CALLING FOR A PUBLIC
HEARING WITH RESPECT TO THE CONSTRUCTION OF
A NEW PUMP STATION AND IMPROVEMENTS FOR
THE SLEEPY HOLLOW SEWER DISTRICT IN THE
TOWN OF OSWEGO

WHEREAS, the Town Board of the Town of Oswego (the “Town”) caused a
Preliminary Engineering Report dated July 2023 (the “Report”) outlining all aspects of proposed
wastewater treatment facility improvements for the Sleepy Hollow Sewer District, together with
an estimate of the cost thereof, to be prepared by BCA Architects & Engineers, competent
engineers duly licensed by the State of New York (the “Engineer”), which Report has been duly
filed with the Town Clerk in accordance with the requirements of Article 12 of the Town Law;
and

WHEREAS, installation and construction of the proposed improvements will not change
the boundaries of the Sleepy Hollow Sewer District; and

WHEREAS, pursuant to Article 8 of the Environmental Conservation Law and the
regulations contained in 6 NYCRR Part 617 adopted pursuant thereto by the Department of
Environmental Conservation of the State of New York, (hereafter “SEQRA”), the Town Board
by resolution duly adopted on December 12, 2023 (the “SEQRA Resolution”), and based on its
examination of the Environmental Assessment Form (“EAF”), the criteria set forth in Sections
617.11 and 617.6 of the regulations, and such further investigation as the Town Board deemed
appropriate, determined that the Project will not cause a significant impact on the environment,
and the Town Board will not require the preparation of an environmental impact statement and
ordered that a negative declaration is to be prepared and circulated in accordance with the
requirements of SEQRA and the regulations thereunder; and
WHEREAS, the Town Board adopted a resolution on April 3, 2024 calling for a public
hearing (the “Initial April Resolution”); and
WHEREAS, the publication of the legal notice setting a public hearing was not
published as required and in accordance with the Town Law; and
WHEREAS, the Town Board desires to rescind the Initial April Resolution and to adopt
this Resolution;
NOW, THEREFORE, on motion duly made and seconded, it is

FOUND, ORDERED AND DETERMINED that the Report prepared by the Engineer
has been duly filed with the office of the Town Clerk as required by law, and is available thereat
for public inspection, and it is

FOUND, ORDERED AND DETERMINED that the improvements include installing a
new wastewater pumping station to collect wastewater and transmit flows from the Sleepy

Hollow Sewer District to the Lakeshore Commercial Sewer District, a new emergency generator
and an automatic transfer switch, construction of a new force main, electrical improvements and
decommissioning of the existing wastewater treatment facilities; and

FOUND, ORDERED AND DETERMINED that the total maximum amount proposed
to be expended for the installation and construction of the improvements for the Sleepy Hollow
Sewer District shall be $1,850,000.00, and it is

FOUND, ORDERED AND DETERMINED that the annual cost of the improvements
to the typical property within the proposed District shall be $1,520, and the annual cost of the
proposed District to the typical one or two family home within the District shall be $1,520, and it
is

FOUND, ORDERED AND DETERMINED that the project is proposed to be financed
through grant monies and low cost loans to be received from the New York State Environmental
Facilities Corporation (EFC), the New York State Water Infrastructure Improvement Act
(WIIA), New York State Clean Water State Revolving Fund (CWSRF) and New York State
Water Quality Improvements Program (WQIP). The remaining portion of the financing (the
local share) shall be obtained through the issuance of municipal bonds and notes, and it is

ORDERED, that the Initial April Resolution is hereby rescinded; and be it

ORDERED, that a public hearing of the Town Board of the Town shall be held meet in
the Town Hall located at 2320 County Route 7, Oswego, New York on May 14, 2024, at 6:15
p.m. pursuant to Section 209-d of the Town Law to consider the proposed improvements and the
maximum cost of the Project and to hear all persons interested in the subject thereof, concerning
the same and for such other action on the part of the Town Board with relation thereto as may be
required by law; and be it

ORDERED, that the Town Clerk publish at least once in The Palladium-Times, a
newspaper having a general circulation in the Town and hereby designated as the official
newspaper of the Town for such publication, and post on the sign board of the Town maintained
pursuant to subdivision 6 of section 30 of the Town Law, a copy of this order, certified by said
Town Clerk, the first publication thereof and said posting to be not less than ten (10) nor more
than twenty (20) days before the date of such public hearing; and be it

FURTHER ORDERED, this Resolution and Order shall take effect immediately.
